His Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to section 63 (see footnote a) of the Family Orders and Agreements Enforcement Assistance Act (see footnote b), hereby makes the annexed Order Amending the Schedule to the Family Orders and Agreements Enforcement Assistance Act.

AMENDMENT
1. The schedule to the Family Orders and Agreements Enforcement Assistance Act (see footnote 1) is replaced by the schedule set out in the schedule to these Regulations.

REGULATORY IMPACT ANALYSIS STATEMENT

Issue and objectives
The schedule to the Family Orders and Agreements Enforcement Assistance Act (FOAEAA), which became effective on May 1, 1997, lists the licences that the federal government can suspend, deny or refuse to renew when an individual does not fulfill his or her family support obligations.
As a result of changes made to the personnel marine licensing program, references to certain marine licences in the schedule are now inaccurate. These inaccuracies may result in not being able to enforce the FOAEAA in relation to these licences.
The federal licence denial measure serves a number of purposes. For example, it fully supports the efforts of the provinces and territories to enforce support obligations, augments the licence denial efforts of the provinces and territories, and provides the Provincial Enforcement Services (PES) with another tool to reach payors beyond their provincial borders. The amendments maintain the effectiveness of the measure.
Description and rationale
The amendments update references to the marine licences listed in the schedule to take into account changes to the licensing scheme resulting from the coming into effect of the Marine Personnel Regulations (Regulations) under the Canada Shipping Act, 2001. The Order adds new certificates issued under the Regulations and deletes others that are no longer issued and are no longer valid.
The inclusion of the passport and various aviation licences is unchanged by this Order.
The federal licence denial program is a tool to help the provinces and territories to enforce family support. At the request of a PES, the federal government can suspend, deny or refuse to renew licences listed in the schedule to the FOAEAA in cases where an individual has failed to meet support obligations for three payment periods or has accumulated arrears of at least $3,000. It is a measure of last resort when other enforcement actions by a PES have not succeeded. The measure targets more serious cases of default and has the potential to bring into compliance an especially difficult group of payors to enforce against. It is an “indirect” type of enforcement aimed at attracting the attention of payors by inhibiting them from an activity or use of an asset if they do not contact the PES to resolve outstanding arrears or to make arrangements to begin paying down their support debt.
This Order is not expected to provide savings or additional costs to the government as the licence denial program is already in place. Current activities will continue with respect to licences currently listed and those added.
Since its beginning in 1997, the licence denial measure has proven effective at different stages of the process in encouraging debtors to initiate contact with the PES and in reducing support arrears owing. Licence denial is one of many tools to enforce family support obligations. In its decision in Caruso v. Canada and Québec (A.G.), (see footnote 2) the Quebec Superior Court makes reference to data from the PES of Quebec, Ontario, Alberta and British Columbia, which account for 93% of all licence denial applications sent to the federal Department of Justice since May 1997. For example, Ontario examined cases where a notice of intention to apply for federal licence denial was sent between April and October 2006, and found that 565 of 1 085 cases had reduced the arrears owing by an average amount of $6,900. During the same period, of 1 175 cases where a licence denial application was sent, 342 cases reduced their arrears by an average amount of $7,696. Reduction of arrears is achieved by partial or total payment of arrears, rescheduled payment of arrears, or by getting a new judgment to change the amount of arrears. While these positive outcomes could also be the result of any earlier enforcement measure, or combination of enforcement measures, licence denial has proven effective in getting the attention of payors, especially those who have been out of contact with the PES for a considerable length of time. The measure has succeeded in producing large payments from a selected set of payors, namely those payors who have the ability to pay, but nonetheless evade payment and/or stop contacting the PES.
Consultation
No public consultations were held as the amendments update an existing legislative program by reflecting changes made to the names of various marine licences and adding a few others to the schedule. Consultations were held with the Department of Transport Canada to ensure accuracy in the licences listed in the schedule.
Implementation, enforcement and service standards
The public can find additional information on the federal licence denial program by accessing the FOAEAA, by contacting a PES or the Family, Children and Youth Section of the Department of Justice Canada or by accessing their Web sites.
Licence denial applications under the FOAEAA are made by a PES. A PES would send a notice to the debtor advising him or her that if they do not make arrangements to deal with the support arrears with the PES within 40 days, the PES will formally apply to have their federal licences suspended or denied should they apply for one in the future. Once the application is processed, notice is sent to Transport Canada and Passport Canada to take action. The payor’s name is also placed on a “control” list which denies them a future federal licence, including a passport, should they apply for one.
