His Excellency the Governor General in Council, on the recommendation of the Minister of Fisheries and Oceans, pursuant to paragraph 38(9)(a) of the Fisheries Act (see footnote a), hereby makes the annexed Deposit Out of the Normal Course of Events Notification Regulations.
DEPOSIT OUT OF THE NORMAL COURSE OF EVENTS NOTIFICATION REGULATIONS
1. (1) For the purpose of subsection 38(4) of the Fisheries Act, the following persons are prescribed:
- (a) those providing 24-hour emergency telephone service provided by the office set out in column 2 of the schedule for the province, set out in column 1, where the occurrence of the deposit of a deleterious substance out of the normal course of events or the serious and imminent danger of such a deposit takes place; or
- (b) the pollution prevention officer referred to in paragraph 5(8)(a) or subsection 5(9) of the Pollutant Discharge Reporting Regulations, 1995.
(2) Any person required by subsection 38(4) of the Fisheries Act to report the occurrence of a deposit of a deleterious substance out of the normal course of events or the serious and imminent danger of such a deposit shall without delay notify
- (a) in all cases other than those mentioned in paragraph (b), an inspector or a person referred to in paragraph (1)(a) at the applicable telephone number set out in column 3 of the schedule; or
- (b) in the case of the master of a vessel, the owner of a vessel or the operator of an oil handling facility to whom the Pollutant Discharge Reporting Regulations, 1995 apply, an inspector or the person referred to in paragraph (1)(b).
2. These Regulations come into force on the day on which they are registered.
