CANADIAN ENVIRONMENTAL PROTECTION ACT, 1999

Order 2012-87-09-01 Amending the Domestic Substances List

Whereas the Minister of the Environment has been provided with information under either paragraph 87(1)(a) or (5)(a) of the Canadian Environmental Protection Act, 1999 (see footnote a) in respect of each substance referred to in the annexed Order;

Whereas, in respect of the substances being added to the Domestic Substances List (see footnote b) pursuant to subsection 87(1) of that Act, the Minister of the Environment and the Minister of Health are satisfied that those substances have been manufactured in or imported into Canada, by the person who provided the information, in excess of the quantity prescribed under the New Substances Notification Regulations (Chemicals and Polymers) (see footnote c);

Whereas the period for assessing the information under section 83 of that Act has expired;

And whereas no conditions under paragraph 84(1)(a) of that Act in respect of the substances are in effect;

Therefore, the Minister of the Environment, pursuant to subsections 87(1) to (3) and (5) of the Canadian Environmental Protection Act, 1999 (see footnote d), makes the annexed Order 2012-87-09-01 Amending the Domestic Substances List.

ORDER 2012-87-09-01 AMENDING THE DOMESTIC SUBSTANCES LIST

AMENDMENTS

1. Paragraph 2(1)(a) of the Domestic Substances List (see footnote 1) is replaced by the following:

  • (a) Part 1, which sets out chemicals and polymers, except those referred to in paragraphs (b) to (d), identified by their Chemical Abstracts Service Registry Number or by the Substance Identity Number assigned by the Department of the Environment and the name of the substance if a Chemical Abstracts Service Registry Number does not identify the substance.

2. The heading of Part 1 of the List is replaced by the following:

Significant New Activity for which substance is subject to subsection 81(3) of the Act

  1. Any of the following activities involving the substance fatty acids, reaction products with alkanolamine and alkyloxide:
    • (a) the use of the substance in Canada in a personal care product, non-industrial and non-commercial cleaning product, or non-industrial and non-commercial lubricant product in a quantity that exceeds 100 kg in any one calendar year;
    • (b) any other use of the substance in Canada other than as a fuel additive or industrial lubricant in a quantity that exceeds 50 000 kg in any one calendar year; or
    • (c) the manufacture of the substance in Canada in a quantity that exceeds 50 000 kg in any one calendar year.
  2. For each proposed significant new activity, the following information must be provided to the Minister at least 90 days before the day on which the significant new activity begins:
    • (a) for the significant new activity described in paragraph 1(a), the name and concentration of each component in the product;
    • (b) for the significant new activity described in paragraph 1(b)
      • (i) if there is a release of the substance to the aquatic environment in a quantity that exceeds 3 kg per day per site that is averaged monthly and after wastewater treatment, the information specified in subparagraphs 7(2)(a)(i) and (ii) of the New Substances Notification Regulations (Chemicals and Polymers), and
      • (ii) the information specified in paragraph 7(3)(b) of those Regulations;
    • (c) for the significant new activity described in paragraph 1(c)
      • (i) if there is a release of the substance to the aquatic environment in a quantity that exceeds 3 kg per day per site that is averaged monthly and after wastewater treatment, the information specified in subparagraphs 7(2)(a)(i) and (ii) of the New Substances Notification Regulations (Chemicals and Polymers),
      • (ii) the information specified in paragraph 7(3)(b) of those Regulations,
      • (iii) a brief description of the manufacturing process that details the reactants used to produce the substance, reaction stoichiometry, batch or continuous nature of the process, and scale of the process,
      • (iv) a flow diagram describing the manufacturing process and its main components such as process tanks, holding tanks and distillation towers, and
      • (v) a brief description of the main steps in manufacturing operations, the chemical conversions, the points of entry of all reactants, the points of release of the substance, and the processes to eliminate environmental release;
    • (d) a description of the significant new activity in relation to the substance;
    • (e) the information specified in Schedule 4 to the New Substances Notification Regulations (Chemicals and Polymers);
    • (f) the information specified in items 8 and 10 of Schedule 5 to those Regulations;
    • (g) the anticipated annual quantity of the substance to be used for the significant new activity;
    • (h) the identification of every other government agency, either outside or within Canada, that the person proposing the significant new activity has notified of the use of the substance and, if known, the agency’s file number, the outcome of the assessment and, if any, the risk management actions in relation to the substance imposed by the agency;
    • (i) if known, the three sites in Canada where the greatest quantity of the substance, in relation to the significant new activity, is anticipated to be used or processed and the estimated quantity by site; and
    • (j) all other information or test data concerning the substance that are in the possession of or accessible to the person who proposes to use the substance for the significant new activity and that are relevant to determining whether the substance is toxic or capable of becoming toxic.
  3. The above information will be assessed within 90 days after the day on which it is received by the Minister.

COMING INTO FORCE

6. This Order comes into force on the day on which it is registered.
