FARM PRODUCTS AGENCIES ACT

Order Amending the Canadian Broiler Hatching Egg Marketing Levies Order

Whereas the Governor in Council has, by the Canadian Hatching Egg Producers Proclamation (see footnote a), established Canadian Hatching Egg Producers pursuant to subsection 16(1) (see footnote b) of the Farm Products Agencies Act (see footnote c);

Whereas Canadian Hatching Egg Producers has been empowered to implement a marketing plan pursuant to that Proclamation;

Whereas the proposed Order Amending the Canadian Broiler Hatching Egg Marketing Levies Order is an order of a class to which paragraph 7(1)(d) (see footnote d) of that Act applies by reason of section 2 of the Agencies’ Orders and Regulations Approval Order (see footnote e), and has been submitted to the National Farm Products Council pursuant to paragraph 22(1)(f) of that Act;

And whereas, pursuant to paragraph 7(1)(d) (see footnote f) of that Act, the National Farm Products Council has approved the proposed Order, after being satisfied that it is necessary for the implementation of the marketing plan that Canadian Hatching Egg Producers is authorized to implement;

Therefore, Canadian Hatching Egg Producers, pursuant to paragraph 22(1)(f) of the Farm Products Agencies Act (see footnote g) and section 8 of the schedule to the Canadian Hatching Egg Producers Proclamation (see footnote h), makes the annexed Order Amending the Canadian Broiler Hatching Egg Marketing Levies Order.

ORDER AMENDING THE CANADIAN BROILER HATCHING EGG MARKETING LEVIES ORDER

AMENDMENTS

1. (1) The definitions “Agency”, “broiler hatching egg”, “chick”, “Commodity Board”, “marketing”, “non-signatory provinces”, “producer” and “signatory provinces” in section 1 of the Canadian Broiler Hatching Egg Marketing Levies Order (see footnote 1) are repealed.

(2) Section 1 of the Order is renumbered as subsection 1(1) and is amended by adding the following:

(2) Unless otherwise provided, the definitions in section 1 of the schedule to the Canadian Hatching Egg Producers Proclamation apply in this Order.

2. (1) Subsection 2(1) of the Order is amended by striking out “and” at the end of paragraph (c) and by adding the following after paragraph (d):

(2) Subsection 2(2) of the Order is replaced by the following:

(2) A levy is imposed on a producer, dealer or hatchery operator in a non-signatory province of $0.01112 per broiler hatching egg produced in a non-signatory province and marketed by that producer, dealer or hatchery operator in interprovincial trade into a signatory province.

COMING INTO FORCE

3. This Order comes into force on the day on which it is registered.

EXPLANATORY NOTE

(This note is not part of the Order.)

The expression “Canadian Broiler Hatching Egg Marketing Agency” is replaced by “Canadian Hatching Egg Producers” to reflect the current name of the Agency.

The definitions in the Canadian Hatching Egg Producers Proclamation are incorporated by reference and definitions duplicating those in the Proclamation (i.e. “Agency,” “broiler hatching egg,” “chick,” “Commodity Board,” “marketing,” “non-signatory provinces,” “producer,” and “signatory provinces”) are repealed.

Section 1 of the Order is renumbered as subsection 1(1) and is amended by adding subsection 1(2).

The amendments set the levies imposed on producers in Saskatchewan and Alberta, for broiler hatching eggs marketed by those producers in interprovincial or export trade. The amendments also increase the levy on producers, dealers and hatchery operators in non-signatory provinces for broiler hatching eggs marketed in interprovincial trade into signatory provinces.
