FARM PRODUCTS AGENCIES ACT
Regulations Amending the Canadian Broiler Hatching Egg and Chick Licensing Regulations
Whereas the Governor in Council has, by the Canadian Hatching Egg Producers Proclamation (see footnote a), established Canadian Hatching Egg Producers pursuant to subsection 16(1) (see footnote b) of the Farm Products Agencies Act (see footnote c);
And whereas Canadian Hatching Egg Producers has been empowered to implement a marketing plan pursuant to that Proclamation;
Therefore, Canadian Hatching Egg Producers, pursuant to paragraph 22(1)(f) of the Farm Products Agencies Act (see footnote d) and section 7 of the schedule to the Canadian Hatching Egg Producers Proclamation (see footnote e), makes the annexed Regulations Amending the Canadian Broiler Hatching Egg and Chick Licensing Regulations.

REGULATIONS AMENDING THE CANADIAN BROILER HATCHING EGG AND CHICK LICENSING REGULATIONS
AMENDMENTS
1. (1) The definitions “Agency”, “broiler hatching egg”, “chick”, “marketing”, “non-signatory provinces”, “producer” and “signatory provinces” in section 2 of the Canadian Broiler Hatching Egg and Chick Licensing Regulations (see footnote 1) are repealed.
(2) Section 2 of the Regulations is renumbered as subsection 2(1) and is amended by adding the following:
(2) Unless otherwise provided, the definitions in section 1 of the schedule to the Canadian Hatching Egg Producers Proclamation apply in these Regulations.
2. (1) Subparagraph 7(a)(i) of the Regulations is replaced by the following:
- (i) at all times during the term of the licence complies with the orders, regulations or requirements of the Agency or the National Farm Products Council that are applicable to that person,
(2) Subparagraphs 7(a)(ii) and (iii) of the English version of the Regulations are replaced by the following:
- (ii) at all times during the term of the licence complies with the orders, regulations or directives made pursuant to a provincial broiler hatching egg marketing plan referred to in the Federal-Provincial Agreement for Broiler Hatching Eggs, authorized by Order in Council P.C. 1986-2653 (see footnote 2), that are applicable to that person,
- (iii) submits to the Agency in respect of the period set out in the licence a report containing the information set out in the schedule, and
(3) Subparagraph 7(b)(iii) of the Regulations is replaced by the following:
- (iii) in the interprovincial marketing from a non-signatory province into a signatory province of broiler hatching eggs produced in the non-signatory province, except for broiler hatching eggs that have been marketed by a person who has been allotted an orderly marketing quota pursuant to the Canadian Broiler Hatching Egg and Chick Orderly Marketing Regulations.
3. (1) The portion of section 8 of the English version of the Regulations before paragraph (c) is replaced by the following:
8. (1) The Agency may refuse to issue a licence to an applicant
- (a) who is a producer, if the applicant has not been allotted a quota by the Agency pursuant to the Canadian Broiler Hatching Egg and Chick Orderly Marketing Quota Regulations or the Canadian Hatching Egg Producers Quota Regulations;
- (b) if the applicant does not comply with any order, regulation or requirement of the Agency or the National Farm Products Council that is applicable to the applicant; or
(2) Paragraphs 8(1)(a) and (b) of the French version of the Regulations are replaced by the following:
- a) qui est producteur, si celui-ci ne détient pas un contingent attribué conformément au Règlement des Producteurs d’œufs d’incubation du Canada sur le contingentement ou au Règlement canadien sur la commercialisation des œufs d’incubation de poulet de chair et des poussins;
- b) si celui-ci ne se conforme pas aux ordonnances, règlements ou exigences de l’Office ou du Conseil national des produits agricoles qui le visent;
4. The schedule to the French version of the Regulations is amended by replacing “(sous-alinéa 7a)(iii)” after the heading “ANNEXE” with “(sous-alinéa 7a)(iii))”.
5. Item 3 of the schedule to the English version of the Regulations is replaced by the following:
- 3. The name, address and licence number of the licencee from whom the broiler hatching eggs or chicks were bought or to whom the broiler hatching eggs or chicks were sold.
COMING INTO FORCE
6. These Regulations come into force on the day on which they are registered.
EXPLANATORY NOTE
(This note is not part of the Regulations.)
The expression “Canadian Broiler Hatching Egg Marketing Agency” is replaced by “Canadian Hatching Egg Producers,” to reflect the current name of the Agency. References to the Farm Products Agencies Act, the Canadian Hatching Egg Producers Proclamation and the National Farm Products Council are updated to reflect the current instruments.
The definitions in the Canadian Hatching Egg Producers Proclamation are incorporated by reference and definitions duplicating those in the Proclamation (i.e. “Agency,” “broiler hatching egg,” “chick,” “marketing,” “non-signatory provinces,” “producer” and “signatory provinces”) are repealed.
Section 2 of the Regulations is renumbered as subsection 2(1) and is amended by adding subsection 2(2).
Subparagraph 7(a)(i) of the Regulations is replaced.
Subparagraphs 7(a)(ii) and (iii) of the English version of the Regulations are replaced.
Subparagraph 7(b)(iii) of the Regulations is replaced.
The portion of section 8 of the English version of the Regulations before paragraph (c) is replaced.
Paragraphs 8(1)(a) and (b) of the French version of the Regulations are replaced.
The schedule to the French version of the Regulations is amended by replacing “sous-alinéa 7a)(iii)” after the heading “ANNEXE’’ with “(sous-alinéa 7a)(iii)”.
Item 3 of the schedule to the English version of the Regulations is replaced.
