Regulations Amending the Immigration and Refugee Protection Regulations (Miscellaneous Program)

His Excellency the Governor General in Council, on the recommendation of the Minister of Citizenship and Immigration, pursuant to subsection 5(1) and sections 14 (see footnote a), 26 (see footnote b), 116 and 201 of the Immigration and Refugee Protection Act (see footnote c), makes the annexed Regulations Amending the Immigration and Refugee Protection Regulations (Miscellaneous Program).
REGULATIONS AMENDING THE IMMIGRATION AND REFUGEE PROTECTION REGULATIONS (MISCELLANEOUS PROGRAM)
AMENDMENTS
1. Subsection 1(2) of the French version of the Immigration and Refugee Protection Regulations (see footnote 1) is replaced by the following:
Assimilation au conjoint de fait
(2) Pour l’application de la Loi et du présent règlement, est assimilée au conjoint de fait la personne qui entretient une relation conjugale depuis au moins un an avec une autre personne mais qui, en raison d’une persécution ou d’une forme quelconque de répression pénale, ne peut vivre avec elle.
2. (1) The definition “aide familial” in section 2 of the French version of the Regulations is replaced by the following:
« aide familial »
“live-in caregiver”
« aide familial » Personne qui fournit sans supervision des soins à domicile à un enfant, à une persone âgée ou à une personne handicapée, dans une résidence privée située au Canada où résident à la fois la personne bénéficiant des soins et celle qui les fournit.
(2) The portion of paragraph (a) of the definition “enfant à charge” in section 2 of the French version of the Regulations before subparagraph (i) is replaced by the following:
- a) d’une part, par rapport à l’un de ses parents :
3. Paragraph 83(1)(d) of the Regulations is replaced by the following:
- (d) for being related to, or for having an accompanying spouse or accompanying common-law partner who is related to, a person living in Canada who is described in subsection (5), 5 points; and
4. (1) Paragraph 98(1)(c) of the French version of the Regulations is replaced by the following:
- c) il crée pour des citoyens canadiens ou des résidents permanents, à l’exclusion de lui-même et des membres de sa famille, au moins un équivalent d’emploi à temps plein supplémentaire dans l’entreprise canadienne admissible.
(2) Subsection 98(2) of the French version of the Regulations is replaced by the following:

5. (1) Paragraph 105(1)(c) of the English version of the Regulations is replaced by the following:
- (c) for any previous period of work in Canada by the member or their spouse or common-law partner, 5 points; and
(2) Paragraph 105(1)(d) of the Regulations is replaced by the following:
- (d) for being related to, or for having an accompanying spouse or accompanying common-law partner who is related to, a person living in Canada who is described in subsection (5), 5 points.
(3) Subsection 105(3) of the Regulations is replaced by the following:
Previous study in Canada
(3) For the purposes of paragraph (1)(b), a member of the self-employed persons class shall be awarded 5 points if the member or their accompanying spouse or accompanying common-law partner, on or after their 17th birthday, completed a program of full-time study of at least two years’ duration at a post-secondary institution in Canada under a study permit, whether or not they obtained an educational credential for completing that program.
6. (1) The portion of subsection 108(2) of the French version of the Regulations before paragraph (a) is replaced by the following:

7. Paragraph 117(3)(e) of the French version of the Regulations is replaced by the following:

8. Paragraph 131(b) of the English version of the Regulations is replaced by the following:
- (b) if the sponsor resides in a province that has entered into an agreement referred to in subsection 8(1) of the Act that enables the province to determine and apply financial criteria with respect to sponsorship undertakings and to administer sponsorship undertakings, to the competent authority of the province.
9. Subsection 132(3) of the Regulations is replaced by the following:
Undertaking to province — alternate duration
(3) Despite subsection (2), the period referred to in subsection (1) shall end not later than the day provided for by the laws of the province if that day is
- (a) in the case of a foreign national referred to in paragraph (2)(a), earlier than the last day referred to in that paragraph;
- (b) in the case of a foreign national referred to in paragraph (2)(b), earlier than the later of the days referred to in subparagraph (2)(b)(i) and (ii);
- (c) in the case of a foreign national referred to in paragraph (2)(c), earlier than the last day referred to in that paragraph;
- (d) in the case of a foreign national referred to in paragraph (2)(d), earlier than the last day referred to in that paragraph; and
- (e) in the case of a foreign national referred to in paragraph (2)(e), earlier than the last day referred to in that paragraph.
10. Subparagraph 133(1)(g)(i) of the English version of the Regulations is replaced by the following:
- (i) any sponsorship undertaking, or
11. Subparagraph 135(a)(i) of the French version of the Regulations is replaced by the following:
- (i) dès qu’une administration effectue un paiement que le répondant est tenu de rembourser au titre de l’engagement,
12. Paragraph 136(1)(a) of the Regulations is replaced by the following:
- (a) the revocation of citizenship under the Citizenship Act;
13. Subsection 139(4) of the French version of the Regulations is replaced by the following:

14. Paragraph 141(1)(d) of the Regulations is replaced by the following:
- (d) if the applicant is the subject of a sponsorship application referred to in paragraph 139(1)(f)(i), their sponsor has been notified of the family member’s application and an officer is satisfied that there are adequate financial arrangements for resettlement; and
15. (1) Paragraph 153(4)(a) of the French version of the Regulations is replaced by the following:
- a) dans le cas du répondant qui manque à une obligation financière, il a remboursé, en totalité ou selon tout accord conclu avec le gouvernement intéressé, les sommes payées par celui-ci;
(2) Paragraph 153(4)(b) of the Regulations is replaced by the following:
- (b) in the case of a party, other than an organization or association, who defaults on a financial obligation, when the defaulting party has reimbursed any other party to the sponsorship, in full or in accordance with an agreement with that party, for amounts paid by that party;
(3) Paragraph 153(4)(d) of the French version of the Regulations is replaced by the following:

16. Paragraph 177(a) of the English version of the Regulations is replaced by the following:
- (a) the class of persons who have been the subject of a decision under section 108 or 109 or subsection 114(3) of the Act resulting in the rejection of a claim for refugee protection or nullification of the decision that led to conferral of refugee protection;
17. Paragraph 251(b) of the French version of the Regulations is replaced by the following:

18. Section 362 of the French version of the Regulations is replaced by the following:
Investisseurs
362. Si l’étranger, avant le 1er avril 1999, a présenté une demande de visa d’immigrant à titre d’investisseur et signé le document visé à la division 1v)(iii)(A) de l’annexe X de l’ancien règlement, dans sa version antérieure à cette date, ou, s’il s’agit d’un investisseur d’une province, soit a présenté une demande de certificat de sélection aux termes de l’article 3.1 de la Loi sur l’immigration au Québec, L.R.Q., ch. I-0.2, compte tenu de ses modifications successives, soit a présenté une demande de visa d’immigrant à titre d’investisseur, et a signé une convention d’investissement selon les lois de la province, les dispositions de l’ancien règlement applicables aux demandeurs de visa d’immigrant à titre d’investisseur, aux investisseurs d’une province, aux gestionnaires, aux dépositaires, aux entreprises admissibles, aux entreprises agréées, aux fonds, aux fonds agréés, aux fonds de capital-risque administrés par le secteur privé et aux fonds de capital-risque administrés par un gouvernement continuent de s’appliquer, dans leur version antérieure au 1er avril 1999, à toute personne qui, avant cette date, était régie par elles.

19. These Regulations come into force on the day on which they are registered.
REGULATORY IMPACT ANALYSIS STATEMENT
(This statement is not part of the Regulations.)
Issues and objectives
In 2006, the Standing Joint Committee for the Scrutiny of Regulations (SJCSR), a parliamentary committee whose mandate involves reviewing and scrutinizing federal statutory instruments after reviewing the Immigration and Refugee Protection Regulations (the Regulations) submitted its comments noting various technical errors and inconsistencies that require attention by Citizenship and Immigration Canada (CIC). These include inconsistencies between the English and French versions of the Regulations, inconsistencies in terminology throughout the Regulations and the need to clarify certain provisions. CIC seeks to ensure that the technical wording of the Regulations is internally consistent and accurate in each official language and that the Regulations are clear and consistent as a whole.
Description
The Regulations are being amended in order to correct technical inconsistencies, including those identified by the SJCSR in 2006 and others identified by CIC. The amendments fall into the following three broad categories:
- Harmonizing the English and French versions of the Regulations. For example, this includes amendments to ensure that both the English and French versions of the Regulations are written in the same verb tense.
- Ensuring consistency in terminology throughout the Regulations. For example, this includes amendments to ensure that the same words or phrases are used throughout the Regulations to express the same meaning.
- Correcting instances where more precise or appropriate language can be used to express the policy intent of the Regulations, in either the English or French versions. The amendments make non-substantive clarifications, such as specifying precise references to related provisions in the Regulations or providing more detailed explanations or descriptions of the intent of certain provisions.
Consultation
These amendments to the Regulations are administrative in nature, do not impose new restrictions or regulatory burdens on individuals or businesses and will have little impact on Canadians. Therefore, no consultations were conducted.
“One-for-One” Rule
The “One-for-One” Rule does not apply to these amendments, as there are no changes in administrative costs to business.
Small business lens
The small business lens does not apply to these amendments, as there are no costs to small businesses.
Rationale
These regulatory amendments are a response to the SJCSR’s review of the Regulations, as well as one technical amendment identified by CIC. The amendments do not impose any costs on government or stakeholders. The amendments ensure harmonization between the English and French versions of the Regulations and ensure their precision and clarity.
Implementation, enforcement and service standards
The amendments are administrative in nature and do not impose new restrictions or regulatory burdens on individuals or industry. Therefore, no changes to the manner in which the Regulations are implemented or enforced are anticipated.
