Whereas the Minister of Indian Affairs and Northern Development has consulted with the member of the Executive Council of Yukon designated by the Commissioner of Yukon as the territorial minister for the purposes of the Yukon Environmental and Socio-economic Assessment Act ^{footnote a} and with the first nations, within the meaning of that Act;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to subsection 47(1) and paragraph 122(c) of the Yukon Environmental and Socio-economic Assessment Act ^{footnote a}, makes the annexed Regulations Amending the Assessable Activities, Exceptions and Executive Committee Projects Regulations (Miscellaneous Program).

Regulations Amending the Assessable Activities, Exceptions and Executive Committee Projects Regulations (Miscellaneous Program)

Amendments

1 (1) Paragraph (b) of the definition pétrole in subsection 1(1) of the French version of the Assessable Activities, Exceptions and Executive Committee Projects Regulations ^{footnote 1} is replaced by the following:

• b) les autres hydrocarbures, à l’exclusion du charbon et du gaz naturel, notamment ceux qui peuvent être extraits ou récupérés de gisement en affleurement ou souterrains de sables pétrolifères, de bitume ou de sables ou schistes bitumineux ou d’autres types de gisements. (oil or petroleum)

(2) The portion of the definition produit antiparasitaire in subsection 1(1) of the French version of the Regulations before paragraph (a) is replaced by the following:

produit antiparasitaire Produit, organisme, substance, dispositif ou autre objet qui est fabriqué, présenté, vendu ou utilisé comme moyen de lutte direct ou indirect, par prévention, destruction, limitation, attraction ou répulsion, contre tout animal, plante ou autre organisme nuisible, nocif ou gênant ou toute fonction organique d’un animal, d’une plante ou d’un organisme nuisible, nocif ou gênant, y compris :

5 The portion of item 27 of Part 13 of Schedule 1 to the English version of the Regulations in columns 1 and 2 is replaced by the following:

27	On land under the administration and control of the Commissioner of Yukon or on settlement land, the construction, operation, modification, decommissioning or abandonment of a structure, facility or installation for the purpose of agriculture, commercial recreation, public recreation, tourist accommodation, telecommunications, trapping or guiding persons hunting members of a species prescribed as a species of big game animal by a regulation made under the Wildlife Act, R.S.Y. 2002, c. 229	(1) On land under the administration and control of the Commissioner of Yukon, or on settlement land, in a municipality — including those settlement lands encircled by the municipality — the construction, operation, modification, decommissioning or abandonment of a structure, facility or installation for the purpose of agriculture, commercial recreation, public recreation, tourist accommodation, telecommunications, trapping or guiding persons hunting members of a species prescribed as a species of big game animal by a regulation made under the Wildlife Act, R.S.Y. 2002, c. 229 (2) In a local advisory area or mapped community, on land under the administration and control of the Commissioner of Yukon or on settlement land, the construction, operation, modification, decommissioning or abandonment of a structure, facility or installation used for the purpose of agriculture, commercial recreation, public recreation, tourist accommodation, telecommunications, trapping or guiding persons hunting members of a species prescribed as a species of big game animal by a regulation made under the Wildlife Act, R.S.Y. 2002, c. 229, if there is another structure, facility or installation located on the same parcel that is already being used in the same undertaking

Coming into Force

6 These Regulations come into force on the day on which they are registered.

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Issues

In February 2018, the Standing Joint Committee for the Scrutiny of Regulations recommended that the Assessable Activities, Exceptions and Executive Committee Projects Regulations (SOR/2005-379) be amended to address the following issues that are administrative in nature:

• Duplication of text
  • Schedule 1, Part 5, Item 5 — English and French references to the activity of “capturing and banding a migratory bird” for scientific or educational purposes, an activity exempted from an environmental and socio-economic assessment, but scheduled under activities subject to an assessment.
• Discrepancies between the English and French versions
  • Subsection 1(1)
    • Definition of “oil or petroleum” — the French version does not render the words “and other types of deposits” used in the English version.
    • Definition of “control product” — the English version does not render the words “ou condition” used in the French version.
  • Schedule 1, Part 6, Item 11 — only the English version refers to watercourse C.
  • Schedule 1, Part 12, Item 4 — in the French version, the word “situé” at the end of the item is unnecessary.
  • Schedule 1, Part 12, Item 12 — the words “prévention ou réduction de l’érosion ou régulation du drainage” are translated by “to control erosion and drainage”.
  • Schedule 1, Part 13, Item 27 — the word “exploitation” (exploitation d’une installation) is translated by “establishment” (establishment of a structure).

Objectives

The amendments have the following objectives:

• Remove duplication of text to provide clarity on an activity subject to an assessment exception.
• Address a few discrepancies between the English and French texts.

Description and rationale

The following amendment provides clarification around a specific exception to the assessable activity of “killing a migratory bird, taking or capturing and banding a migratory bird or taking its nest or eggs for scientific or educational purposes”:

• Schedule 1, part 5, item 5, column 1
  • English version — removing “or capturing and banding”.
  • French version — removing “capture et baguage”.

The following amendments address discrepancies between English and French:

• Subsection 1(1)
  • French definition of “oil or petroleum” — adding “ou d’autres types de gisements” after “bitumineux”.
  • French definition of “control product” — removing “ou condition”.
• Schedule 1, Part 6, Item 11, Column 2
  • English version — removing the “C” that follows “watercourse” in two instances.
• Schedule 1, Part 12, Item 4, Column 1
  • French version — removing “situé” at the end of the item.
• Schedule 1, Part 12, Item 12
  • French version — replacing “prévention ou réduction de l’érosion ou régulation du drainage” by “ou activité pour le contrôle de l’érosion ou du drainage”.
• Schedule 1, Part 13, Item 27, Columns 1 and 2
  • English version — replacing “establishment” by “operation”.

The amendments are in response to a review of the Assessable Activities, Exceptions and Executive Committee Projects Regulations (SOR/2005-379) conducted by the Standing Joint Committee for the Scrutiny of Regulations. They provide precise and clear regulations and help to correct the regulatory base. They do not impose any costs on the Government or stakeholders.

“One-for-One” Rule and small business lens

The “One-for-One” Rule does not apply to these amendments, as there is no change in administrative costs or burdens to business.

The small business lens does not apply to these amendments, as there are no costs to small business.
