Whereas the Minister of Indian Affairs and Northern Development has consulted with the member of the Executive Council of Yukon designated by the Commissioner of Yukon as the territorial minister for the purposes of the Yukon Environmental and Socio-economic Assessment Act footnote a and with the first nations, within the meaning of that Act;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to subsection 47(1) and paragraph 122(c) of the Yukon Environmental and Socio-economic Assessment Act footnote a, makes the annexed Regulations Amending the Assessable Activities, Exceptions and Executive Committee Projects Regulations (Miscellaneous Program).

Amendments

1 (1) Paragraph (b) of the definition pétrole in subsection 1(1) of the French version of the Assessable Activities, Exceptions and Executive Committee Projects Regulations footnote 1 is replaced by the following:

(2) The portion of the definition produit antiparasitaire in subsection 1(1) of the French version of the Regulations before paragraph (a) is replaced by the following:

On land under the administration and control of the Commissioner of Yukon or on settlement land, the construction, operation, modification, decommissioning or abandonment of a structure, facility or installation for the purpose of agriculture, commercial recreation, public recreation, tourist accommodation, telecommunications, trapping or guiding persons hunting members of a species prescribed as a species of big game animal by a regulation made under the Wildlife Act, R.S.Y. 2002, c. 229

(1) On land under the administration and control of the Commissioner of Yukon, or on settlement land, in a municipality — including those settlement lands encircled by the municipality — the construction, operation, modification, decommissioning or abandonment of a structure, facility or installation for the purpose of agriculture, commercial recreation, public recreation, tourist accommodation, telecommunications, trapping or guiding persons hunting members of a species prescribed as a species of big game animal by a regulation made under the Wildlife Act, R.S.Y. 2002, c. 229

(2) In a local advisory area or mapped community, on land under the administration and control of the Commissioner of Yukon or on settlement land, the construction, operation, modification, decommissioning or abandonment of a structure, facility or installation used for the purpose of agriculture, commercial recreation, public recreation, tourist accommodation, telecommunications, trapping or guiding persons hunting members of a species prescribed as a species of big game animal by a regulation made under the Wildlife Act, R.S.Y. 2002, c. 229, if there is another structure, facility or installation located on the same parcel that is already being used in the same undertaking

Coming into Force

6 These Regulations come into force on the day on which they are registered.

In February 2018, the Standing Joint Committee for the Scrutiny of Regulations recommended that the Assessable Activities, Exceptions and Executive Committee Projects Regulations (SOR/2005-379) be amended to address the following issues that are administrative in nature:

Description and rationale

The following amendment provides clarification around a specific exception to the assessable activity of “killing a migratory bird, taking or capturing and banding a migratory bird or taking its nest or eggs for scientific or educational purposes”:

The following amendments address discrepancies between English and French:

The amendments are in response to a review of the Assessable Activities, Exceptions and Executive Committee Projects Regulations (SOR/2005-379) conducted by the Standing Joint Committee for the Scrutiny of Regulations. They provide precise and clear regulations and help to correct the regulatory base. They do not impose any costs on the Government or stakeholders.

“One-for-One” Rule and small business lens

The “One-for-One” Rule does not apply to these amendments, as there is no change in administrative costs or burdens to business.

The small business lens does not apply to these amendments, as there are no costs to small business.
