Her Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to paragraph 26(1)(a) footnote a of the Divorce Act footnote b, makes the annexed Regulations Amending the Central Registry of Divorce Proceedings Regulations.
Regulations Amending the Central Registry of Divorce Proceedings Regulations
Amendments
1 Section 3 of the Central Registry of Divorce Proceedings Regulations footnote 1 is replaced by the following:
3 A central registry of divorce proceedings is established and is to be located in Ottawa, Ontario.
Mandate
3.1 The mandate of the central registry is to assist the court in determining its jurisdiction to hear and determine a divorce proceeding by maintaining a central registry of divorce proceedings in Canada, which is to consist of the information that is provided to it in accordance with sections 4 and 7 and which is to be used to determine whether any other divorce proceedings are pending between the spouses or whether a divorce has already been granted in respect of the marriage.
2 (1) Clauses 4(1)(b)(iv)(B) and (C) of the Regulations are replaced by the following:
- (B) the spouse’s surname and given names on the day before the day of the marriage, and
- (C) the spouse’s gender on the day before the day of the marriage and their date of birth, and
(2) Clauses 4(2)(b)(v)(B) and (C) of the Regulations are replaced by the following:
- (B) the spouse’s surname and given names on the day before the day of the marriage, and
- (C) the spouse’s gender on the day before the day of the marriage and their date of birth.
3 (1) Paragraph 7(1)(c) of the Regulations is replaced by the following:
- (c) the surname and given names of each spouse involved in the divorce proceeding on the day before the day of the marriage.
(2) Paragraph 7(2)(b) of the Regulations is replaced by the following:
- (b) the surname and given names of each spouse involved in the divorce proceeding on the day before the day of the marriage; and
Coming into Force
4 These Regulations come into force on the day on which section 24 of An Act to amend the Divorce Act, the Family Orders and Agreements Enforcement Assistance Act and the Garnishment, Attachment and Pension Diversion Act and to make consequential amendments to another Act, chapter 16 of the Statutes of Canada, 2019, comes into force, but if they are registered after that day, they come into force on the day on which they are registered.
