Whereas the Security Council of the United Nations, acting under Article 41 of the Charter of the United Nations, adopted certain resolutions;

And whereas it appears to the Governor in Council to be necessary to make regulations for enabling the measures set out in those resolutions to be effectively applied;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Foreign Affairs, makes the annexed Regulations Amending Certain Regulations Made Under the United Nations Act (Miscellaneous Program) under section 2 of the United Nations Act ^{footnote a}.

Regulations Amending Certain Regulations Made Under the United Nations Act (Miscellaneous Program)

Regulations Implementing the United Nations Resolutions on the Suppression of Terrorism

1 Paragraph (b) of the definition listed person in section 1 of the Regulations Implementing the United Nations Resolutions on the Suppression of Terrorism ^{footnote 1} is replaced by the following:

(b) any person associated with the Taliban as defined in section 1 of the Regulations Implementing the United Nations Resolutions on Taliban, ISIL (Da’esh) and Al-Qaida. (personne inscrite)

2 The portion of subsection 10(2) of the English version of the Regulations before paragraph (a) is replaced by the following:

(2) If it is established in accordance with Resolution 1452 (2002) of December 20, 2002, adopted by the Security Council of the United Nations, that the property is necessary for basic or extraordinary expenses, the Minister must issue a certificate within the following time periods:

United Nations Iraq Regulations

3 The title of the English version of the United Nations Iraq Regulations ^{footnote 2} is replaced by the following:

4 Section 1 of the Regulations is amended by adding the following in alphabetical order:

Minister: means the Minister of Foreign Affairs. (ministre)

5 Subsection 7(1) of the Regulations is replaced by the following:

7 (1) Every person in Canada and every Canadian outside of Canada who is knowingly in possession or control of any property described in paragraph 5(1)(a) shall, without delay, notify in writing the Director of the Sanctions Policy and Operations Coordination Division of the Department of Foreign Affairs, Trade and Development.

6 (1) Subsection 8.1(1) of the Regulations is replaced by the following:

8.1 (1) A person whose name is the same as or similar to the name of an individual or entity identified by the Committee and that claims not to be that individual or entity may apply to the Minister in writing for a certificate stating that they are not that individual or entity.

(2) Paragraph 8.1(2)(a) of the Regulations is replaced by the following:

(a) if it is established that the applicant is not the individual or entity identified by the Committee, issue the certificate; or

7 The definition entité in section 1 of the French version of the Regulations Implementing the United Nations Resolutions on Iran ^{footnote 3} is replaced by the following:

8 Subsection 6(3) of the French version of the Regulations Implementing the United Nations Resolutions and Imposing Special Economic Measures on Libya ^{footnote 4} is replaced by the following:

9 The definition armed mercenary personnel in section 1 of the Regulations Implementing the United Nations Resolutions on the Central African Republic ^{footnote 5} is repealed.

10 Paragraph 2(1)(e) of the Regulations is replaced by the following:

(e) provide any financial or related services to or for the benefit of any person referred to in paragraph (d) or acquire any such services from or for the benefit of any such person.

11 Sections 15 to 17 of the Regulations, as enacted by SOR/2014-163, are replaced by the following:

Prohibition

18 No legal proceedings lie in Canada at the instance of the Government of the Central African Republic, of any person in the Central African Republic, of a designated person or of any person claiming through or for the benefit of any such person in connection with any contract or other transaction if its performance was prevented by reason of any measure imposed by these Regulations.

Regulations Implementing the United Nations Resolutions on Yemen

12 The definitions armes et matériel connexe and entité in section 1 of the French version of the Regulations Implementing the United Nations Resolutions on Yemen ^{footnote 6} are replaced by the following:

armes et matériel connexe: S’entend notamment de tout type d’armes, de munitions, de véhicules militaires ou de matériel militaire ou paramilitaire et de leurs pièces de rechange. (arms and related material)
entité: S’entend notamment d’une personne morale, d’une fiducie, d’une société de personnes, d’un fonds, d’une organisation ou d’une association non dotée de la personnalité morale ou d’un État étranger. (entity)

13 Subsection 3(2) of the French version of the Regulations is replaced by the following:

Exception

(2) Le paragraphe (1) n’a pas pour effet d’interdire le versement d’intérêts ou de toute autre rémunération, si le versement découle d’une opération ou d’une transaction effectuée avant que la personne ne devienne une personne désignée. Toutefois, ces versements sont alors assujettis au paragraphe (1).

14 Subsection 4(3) of the French version of the Regulations is replaced by the following:

Armes et matériel connexe — biens et services financiers

(3) Il leur est interdit de sciemment rendre disponibles des biens ou de sciemment fournir des services financiers ou connexes à une personne désignée ou à une personne agissant pour son compte ou suivant ses instructions, si ces biens ou services sont liés à la vente, à la fourniture, au transfert, à la fabrication, à l’entretien ou à l’utilisation d’armes et matériel connexe.

15 Subsection 5(2) of the Regulations is repealed.

16 The portion of paragraph 11(2)(c) of the English version of the Regulations before subparagraph (i) is replaced by the following:

(c) within 90 days after receiving the application, in the case of property that is subject to a lien, mortgage or security interest, to a hypothec or prior claim, to a charge or to a judicial, administrative or arbitral decision that

17 Paragraph 12(2)(a) of the English version of the Regulations is replaced by the following:

(a) the contract was entered into or the transfer was carried out prior to any party becoming a designated person; and

18 Subsection 14(2) of the French version of the Regulations is replaced by the following:

Communication par le ministre

(2) Le ministre peut, en vue de l’exécution ou du contrôle d’application du présent règlement ou de l’exécution d’une obligation prévue par une résolution du Conseil de sécurité, communiquer des renseignements personnels au Conseil de sécurité, au Comité du Conseil de sécurité, au Groupe d’experts ou au point focal pour les demandes de radiation.

Coming into Force

19 These Regulations come into force on the day on which they are registered.

REGULATORY IMPACT ANALYSIS STATEMENT

(This statement is not part of the Regulations.)

Issues

A number of non-substantive drafting errors, inconsistencies and redundancies across regulations made under the United Nations Act (UNA) require correction.

Background

The UNA is one of the laws under which Canadian sanctions can be imposed on specific countries, organizations and individuals. Sanctions vary and can encompass a variety of measures, including dealings bans, arms embargoes, asset freezes, and export and import restrictions. The regulations at issue are made under this Act.

Between 2015 and 2019, counsel for the Standing Joint Committee for the Scrutiny of Regulations (SJCSR) identified a number of non-substantive technical issues with several regulations under the UNA. In certain instances, counsel offered corrective suggestions. In 2021, Global Affairs Canada identified a number of additional errors.

Objective

This initiative aims to

correct miscellaneous errors in the regulations requested by the SJCSR and identified by Global Affairs Canada;
continue upholding the integrity of the Canadian regulatory regime by ensuring the regulations are error-free and by eliminating ambiguity; and
ensure consistency both within the regulations (internally), and across various regulations (horizontally).

Description

The Regulations Amending Certain Regulations Made Under the United Nations Act (Miscellaneous Program) make miscellaneous amendments to address changes requested by the SJCSR and identified by Global Affairs Canada, such as ensuring the English and French text are equivalent, correcting typographical or grammatical errors, removing redundant provisions, harmonizing inconsistencies, eliminating duplications, and renumbering provisions.

One-for-one rule and small business lens

The one-for-one rule and small business lens do not apply, as there are no administrative or cost impacts associated with the amendments.
