Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, makes the annexed Regulations Amending the Transportation of Dangerous Goods Regulations (Miscellaneous Program) under subsection 27(1)footnote a of the Transportation of Dangerous Goods Act, 1992 footnote b.
Regulations Amending the Transportation of Dangerous Goods Regulations (Miscellaneous Program)
1 The heading “Coming into Force, Repeal, Interpretation, General Provisions and Special Cases” before section 1.1 of the Transportation of Dangerous Goods Regulations footnote 1 is replaced by the following:
Interpretation, General Provisions and Special Cases
2 The heading “Coming into Force” before section 1.1 and sections 1.1 and 1.2 of the Regulations are repealed.
3 (1) The table to paragraph 1.3(2)(e) of the English version of the Regulations is amended by replacing “cubic feet” in column 2 opposite “ft3” in column 1 with “cubic foot”.
(2) The table to paragraph 1.3(2)(e) of the Regulations is amended by repealing “psig” in column 1 and “pounds per square inch, gauge” in column 2.
(3) Subparagraphs 1.3(2)(j)(i) and (ii) of the Regulations are replaced by the following:
- (i) all other means of containment containing it are removed, the means of containment and the dangerous goods it contains would be in compliance with the Act and these Regulations for the purposes of offering for transport, handling or transport of dangerous goods, and
- (ii) all other means of containment containing it and the means of containment itself are removed, some of the dangerous goods it contains would no longer be in a means of containment that is in compliance with the Act and these Regulations for the purposes of offering for transport, handling or transport of dangerous goods;
4 (1) The definitions certification safety mark, dangerous goods safety mark, Director General, import, permit for equivalent level of safety, safety mark and standardized means of containment in section 1.4 of the Regulations are repealed.
(2) The definition demande de transport in section 1.4 of the French version of the Regulations is repealed.
(3) The definitions shipping document, train and transport index in section 1.4 of the Regulations are replaced by the following:
- shipping document
- means a document that relates to dangerous goods that are being offered for transport, handled or transported and that contains the information required by Part 3 relating to the goods but does not include an electronic record. (document d’expédition)
- train
- means
- (a) a train, as defined in the Canadian Rail Operating Rules, published by The Railway Association of Canada and approved by the Minister under the Railway Safety Act on January 16, 1990, as amended to July 1, 2000; or
- (b) a number of railway vehicles coupled together moving at a velocity exceeding 24 km/h (15 mph) with at least one railway vehicle providing propulsion and at least one railway vehicle containing dangerous goods for which a placard is required to be displayed in accordance with Part 4. (train)
- transport index
- has the same meaning as determined under the Packaging and Transport of Nuclear Substances Regulations, 2015. (indice de transport)
(4) The definition fût in section 1.4 of the French version of the Regulations is replaced by the following:
- fût
- Contenant cylindrique de métal, de carton, de plastique ou d’un autre matériau semblable dont les extrémités sont plates ou convexes et ayant une capacité maximale de 450 L ou, dans le cas d’un fût de contreplaqué, une capacité maximale de 250 L. (5) Section 1.4 of the French version of the Regulations is amended by adding the following in alphabetical order:

5 The heading before section 1.7 of the Regulations is replaced by the following:
Safety Requirements, Documents and Safety Marks
6 (1) The portion of section 1.7 of the Regulations before paragraph (a) is replaced by the following:
1.7 As provided for in section 5 of the Act, a person must not import, offer for transport, handle or transport dangerous goods unless
(2) Paragraph 1.7(c) of the French version of the Regulations is replaced by the following:
- c) les contenants et les moyens de transport doivent être conformes aux normes de sécurité réglementaires applicables et porter les indications de sécurité réglementaires applicables.
7 The heading before section 1.12 and sections 1.12 and 1.13 of the Regulations are repealed.
8 Subparagraph 1.15(1)(a)(ii) of the Regulations is replaced by the following:
- (ii) dangerous goods not included in Class 2, they are in one or more small means of containment designed, constructed, filled, closed, secured and maintained so that under normal conditions of transport, including handling, there will be no release of the dangerous goods that could endanger public safety;
9 (1) Clause 1.16(1)(c)(ii)(A) of the French version of the Regulations is replaced by the following:

(2) Subparagraph 1.16(1)(c)(ii) of the Regulations is amended by striking out “or” at the end of clause (A), by adding “or” at the end of clause (B) and by adding the following after clause (B):

10 (1) Paragraph 1.17(1)(b) of the Regulations is replaced by the following:
- (b) each outer means of containment has a gross mass that is less than or equal to 30 kg and
- (i) if the dangerous goods are a solid or a liquid, the goods in each inner means of containment are in a quantity that is less than or equal to the number shown in column 6(a) of Schedule 1, or
- (ii) if the dangerous goods are a gas, including a gas in a liquefied form, each means of containment in which they are contained has a capacity less than or equal to the number shown in column 6(a) of Schedule 1.
(2) Paragraph 1.17(6)(d) of the Regulations is replaced by the following:
- (d) the UN number of each limited quantity of dangerous goods placed within a square on point.
(3) Subsection 1.17(7) of the Regulations is replaced by the following:
(7) For the purposes of paragraph (6)(d), the line forming the square on point must be black and be at least 2 mm wide. If the dangerous goods have different UN numbers, the square on point must be large enough to include each UN number, but in any case each side must be not less than 50 mm long. The UN numbers must be at least 6 mm high. The line and UN numbers must be on a contrasting background.
11 The portion of subsection 1.17.1(8) of the Regulations before paragraph (a) is replaced by the following:
(8) These Regulations, except for Parts 1 and 2, do not apply to the offering for transport, handling or transport of dangerous goods in excepted quantities that are assigned to alphanumeric codes E1, E2, E4 and E5 in column 6(b) of Schedule 1 if
12 Paragraph 1.19(b) of the Regulations is replaced by the following:
- (b) in one or more means of containment designed, constructed, filled, closed, secured and maintained so that under normal conditions of transport, including handling, there will be no release of the dangerous goods that could endanger public safety.
13 Subparagraph 1.19.1(a)(ii) of the Regulations is replaced by the following:
- (ii) samples that are reasonably believed not to be a gas, they are in one or more means of containment designed, constructed, filled, closed, secured and maintained so that under normal conditions of transport, including handling, there will be no release of the dangerous goods that could endanger public safety;
14 Subparagraph 1.19.2(a)(ii) of the Regulations is replaced by the following:
- (ii) samples not included in Class 2, they are in one or more means of containment designed, constructed, filled, closed, secured and maintained so that under normal conditions of transport, including handling, there will be no release of the dangerous goods that could endanger public safety;
15 Subparagraph 1.21(1)(a)(ii) of the Regulations is replaced by the following:
- (ii) dangerous goods not included in Class 2, they are in one or more means of containment designed, constructed, filled, closed, secured and maintained so that under normal conditions of transport, including handling, there will be no release of the dangerous goods that could endanger public safety;
16 (1) The portion of subsection 1.22(1) of the Regulations before paragraph (a) is replaced by the following:
1.22 (1) Parts 3 to 5 do not apply to the offering for transport, handling or transport of dangerous goods on a road vehicle if

17 Paragraph 1.28(c) of the Regulations is replaced by the following:
- (c) the dangerous goods are in one or more means of containment designed, constructed, filled, closed, secured and maintained so that under normal conditions of transport, including handling, there will be no release of the dangerous goods that could endanger public safety; and
18 The portion of section 1.30.1 of the Regulations before paragraph (a) is replaced by the following:
1.30.1 Subsection 1.6(1) and paragraph 3.6(3)(a) do not apply to dangerous goods that are UN1203, GASOLINE, or UN1978, PROPANE, that are in a highway tank that is being transported by a tank truck on board a passenger carrying vessel that is operating over the most direct water route between two points that are not more than 5 km apart if the following conditions are met:
19 Paragraphs 1.31(a) and (b) of the Regulations are replaced by the following:
- (a) the quantity of each explosive in the road vehicle or railway vehicle that is not subject to special provision 85 or 86 is less than or equal to the number shown in column 6(a) of Schedule 1 for that explosive;
- (b) the quantity of each explosive in the road vehicle or railway vehicle that is subject to special provision 85 or 86 is less than or equal to the number shown in special provision 85 or 86 for that explosive;
20 Paragraph 1.33(c) of the Regulations is replaced by the following:
- (c) are in one or more small means of containment designed, constructed, filled, closed, secured and maintained so that under normal conditions of transport, including handling, there will be no release of the dangerous goods that could endanger public safety.
21 The portion of section 1.41 of the Regulations before paragraph (a) is replaced by the following:
1.41 Parts 3 to 8 do not apply to the offering for transport, handling or transport of biological products if they
22 Subsection 1.42(1) of the Regulations is replaced by the following:
1.42 (1) Parts 3 to 8 do not apply to the offer for transport, handling or transport of human or animal specimens that a person has no reason to believe contain infectious substances.
23 Section 1.42.1 of the Regulations is replaced by the following:
1.42.1 These Regulations do not apply to the offering for transport, handling or transport of tissues or organs for transplant.
24 The portion of section 1.47 of the Regulations before paragraph (a) is replaced by the following:
1.47 Subsection 5.10(1) does not apply to the offering for transport, handling or transport of UN1044, FIRE EXTINGUISHERS, if the fire extinguishers
25 (1) Paragraph 1.49(1)(d) of the English version of the Regulations is replaced by the following:
- (d) the cylinder is closed and secured so that under normal conditions of transport, including handling, there will be no release of the dangerous goods that could endanger public safety;
(2) Subparagraph 1.49(1)(e)(iv) of the Regulations is replaced by the following:
- (iv) the Fishing Vessel Safety Regulations,
26 The portion of subsection 1.50(1) of the Regulations before paragraph (a) is replaced by the following:
1.50 (1) Sections 5.1, 5.2 and 5.5 and subsection 5.10(1) do not apply to the offering for transport, handling or transport of UN1978, PROPANE, in a cylinder on a road vehicle, a railway vehicle or a ship on a domestic voyage if
27 Paragraph 3.4(2)(c) of the Regulations is replaced by the following:
- (c) following the letter “X” opposite the UN number in a column under the heading “DG” or “MD”.
28 (1) Clause 3.5(1)(c)(ii)(A) of the English version of the Regulations is replaced by the following:
- (A) for dangerous goods that are subject to special provision 16, the technical name, in parentheses, of at least one of the most dangerous substances that predominantly contributes to the danger or dangers posed by the dangerous goods, and
(2) Subsection 3.5(2) of the French version of the Regulations is replaced by the following:

29 Paragraph 3.6(3)d) of the Regulations is replaced by the following:
- d) for dangerous goods included in Class 7, the additional information required for transport documents under the Packaging and Transport of Nuclear Substances Regulations, 2015.
30 The portion of subsection 3.6.1(1) of the Regulations before paragraph (a) is replaced by the following:
3.6.1 (1) A shipping document must include, after the information required under section 3.5, one of the following certifications:
31 The portion of subsection 3.10(7) of the Regulations before paragraph (a) is replaced by the following:
(7) The Minister may revoke, in writing, the approval to use a telephone number if
32 (1) Paragraphs 4.4(1)(a) to (c) of the Regulations are replaced by the following:
- (a) display or ensure the display of the required dangerous goods marks on each small means of containment that contains the dangerous goods;
- (b) display or ensure the display of the required dangerous goods marks on each large means of containment that contains the dangerous goods; and
- (c) provide to the carrier the dangerous goods marks for the dangerous goods that the consignor is importing or offering for transport and that are to be transported in a large means of containment.
(2) Subsection 4.4(2) of the Regulations is replaced by the following:
(2) The consignor is not required to provide the dangerous goods marks referred to in paragraph (1)(c) if they
- (a) are already displayed on the large means of containment; or
- (b) are not the correct ones to display because of the presence of other dangerous goods in the large means of containment.
33 The heading before section 4.10.1 of the Regulations is replaced by the following:
Dangerous Goods Marks on an Overpack
34 (1) The portion of subsection 4.10.1(1) of the Regulations before paragraph (a) is replaced by the following:
4.10.1 (1) When a dangerous goods mark is required by this Part to be displayed on a small means of containment and the small means of containment is inside an overpack, the person who prepares the overpack must display
(2) Subsection 4.10.1(4) of the Regulations is replaced by the following:
(4) When dangerous goods included in Class 7 are transported in an overpack and a label is required to be displayed by this Part, the overpack must be prepared in accordance with section 28 of the Packaging and Transport of Nuclear Substances Regulations, 2015.
35 The heading before section 4.10.2 of the Regulations is replaced by the following:
Dangerous Goods Marks on a Consolidation Bin
36 Subsection 4.14(1) of the Regulations is replaced by the following:
4.14 (1) For dangerous goods included in Class 7, the label or placard required to be displayed by this Part must be determined in accordance with the Packaging and Transport of Nuclear Substances Regulations, 2015.
37 Paragraph 4.16(2)(a) of the French version of the Regulations is replaced by the following:

39 Sections 5.1.1 and 5.2 of the Regulations are replaced by the following:
5.1.1 (1) A person must not import, offer for transport, handle or transport dangerous goods in a means of containment unless the means of containment is required or permitted by this Part to be used for the transportation of the dangerous goods.
(2) A person must not offer for transport, handle or transport dangerous goods in a standardized means of containment unless the standardized means of containment is in standard.
(3) A person must not offer for transport, handle or transport dangerous goods in a means of containment that is required or permitted by this Part unless the means of containment is designed, constructed, filled, closed, secured and maintained so that under normal conditions of transport, including handling, there will be no release of the dangerous goods that could endanger public safety.
Requirements for a Standardized Means of Containment to Be in Standard
5.2 A standardized means of containment is in standard with a specific safety standard if
- (a) it has displayed on it the compliance marks required by the standard;
- (b) it was in compliance with the requirements of the standard when each compliance mark was first displayed; and
- (c) it remains in compliance with the requirements of the standard that had to be complied with when each compliance mark was first displayed.
40 The heading before section 5.3 and sections 5.3 and 5.4 of the Regulations are replaced by the following:
Compliance Marks on a Means of Containment
5.3 Any mark required by a safety standard is a compliance mark and must be visible and legible when it is displayed on a means of containment.
Loading and Securing
5.4 A person must load and secure dangerous goods in a means of containment and must load and secure the means of containment on a means of transport in such a way as to prevent, under normal conditions of transport, damage to the means of containment or to the means of transport that could lead to a release of the dangerous goods.
41 Section 5.8 of the Regulations is replaced by the following:
5.8 A person must not offer for transport, handle or transport dangerous goods included in Class 1, unless they are in a means of containment that is selected and used in accordance with CGSB-43.151.
42 (1) Subsections 5.10(2) to (5) of the Regulations are repealed.
(2) Subsections 5.10(7) to (10) of the Regulations are repealed.
43 Section 5.11 of the Regulations is replaced by the following:
5.11 Despite section 5.10, a person must not offer for transport, handle or transport dangerous goods that are UN1950, AEROSOLS, or UN2037, GAS CARTRIDGES, unless they are contained in a means of containment that is manufactured, selected and used in accordance with CGSB-43.123.
44 Section 5.17 of the Regulations is replaced by the following:
5.17 A person must not offer for transport, handle or transport dangerous goods included in Class 7 in a means of containment unless the means of containment is in compliance with the Packaging and Transport of Nuclear Substances Regulations, 2015.
45 (1) The portion of subsection 11.1(2) of the Regulations before paragraph (a) is replaced by the following:
(2) In addition to the requirements in subsection (1), a person who offers for transport, handles or transports dangerous goods by vessel must do so in accordance with the following provisions of these Regulations:
(2) Subparagraph 11.1(2)(c)(ii) of the Regulations is replaced by the following:
- (ii) section 5.3, Compliance marks on a means of containment,
(3) Subsection 11.1(3) of the Regulations is replaced by the following:
(3) The means of containment used to transport the dangerous goods must be designed, constructed, filled, closed, secured and maintained so that under normal conditions of transport, including handling, there will be no release of the dangerous goods that could endanger public safety.
46 Subparagraphs 12.1(1)(a)(iv) and (v) of the Regulations are repealed.
47 Subsection 13.1(1) of the Regulations is replaced by the following:
13.1 (1) A protective direction takes effect on the date on which it is signed by the Minister or at a later date indicated in the protective direction. However, after the effective date of the protective direction, any non-compliance with it must not be enforced against a person unless the person has received the original signed protective direction or an electronic copy of it, or reasonable steps have been taken to make the person aware of the protective direction.
48 The portion of subsection 13.2(2) of the Regulations before paragraph (a) is replaced by the following:
(2) The request must be made, in writing, to the Minister and must include the following information:
49 Section 13.3 of the Regulations and the heading before it are repealed.
50 The headings before section 14.1 of the Regulations are replaced by the following:
PART 14
Equivalency Certificate
Applying for an Equivalency Certificate
51 (1) The portion of section 14.1 of the Regulations before paragraph (a) is replaced by the following:
14.1 A person must apply to the Minister in writing for an equivalency certificate and must include the following information:
(2) Paragraph 14.1(h) of the English version of the Regulations is replaced by the following:
- (h) whether the equivalency certificate is requested for transport by road vehicle, railway vehicle, aircraft or vessel;
(3) The portion of paragraph 14.1(i) of the Regulations before subparagraph (i) is replaced by the following:
- (i) a description of the proposal for an equivalency certificate, including
(4) Paragraphs 14.1(j) and (k) of the Regulations are replaced by the following:
- (j) the length of time or the schedule of activities for which the equivalency certificate is requested; and
- (k) the name, position and business telephone number, including the area code, of the person who can be contacted regarding the application for an equivalency certificate and who is authorized by the applicant to speak on the applicant’s behalf.
52 Section 14.2 of the Regulations and the heading before it are replaced by the following:
Issuance or Refusal of an Equivalency Certificate
14.2 If an application for an equivalency certificate is refused, the Minister must notify the applicant, in writing, of the refusal and the reasons for the refusal.
53 The heading before section 14.3 of the Regulations is replaced by the following:
Applying for Renewal of an Equivalency Certificate
54 (1) The portion of section 14.3 of the Regulations before paragraph (a) is replaced by the following:
14.3 A person must apply to the Minister in writing to renew an equivalency certificate and must include the following information:
(2) Paragraph 14.3(g) of the French version of the Regulations is replaced by the following:

55 Section 14.4 of the Regulations and the heading before it are replaced by the following:
Renewal or Refusal of a Renewal of an Equivalency Certificate
14.4 (1) The Minister may renew an equivalency certificate if the Minister is satisfied, on the basis of the information available and the information submitted with the application for a renewal, that the activity authorized by the equivalency certificate will provide a level of safety at least equivalent to that provided by compliance with the Act and these Regulations.
(2) If an application for a renewal is refused, the Minister must notify the applicant, in writing, of the refusal and the reasons for the refusal.
56 Section 14.5 of the Regulations and the heading before it are replaced by the following:
Revoking an Equivalency Certificate
14.5 The Minister must notify a person, in writing, of the revocation of an equivalency certificate under subsection 31(6) of the Act and the reasons for the revocation.
57 The heading before section 14.6 of the Regulations is replaced by the following:
Requesting a Review of a Decision to Refuse or Revoke an Equivalency Certificate
58 (1) Subsection 14.6(1) of the Regulations is replaced by the following:
14.6 (1) A person may request a review of a decision to refuse or revoke an equivalency certificate within 30 days after the day on which the notification of the decision is received.
(2) The portion of subsection 14.6(2) of the Regulations before paragraph (a) is replaced by the following:
(2) The request must be made in writing to the Minister and must include the following information:
59 Sections 14.7 and 14.8 of the Regulations are replaced by the following:
14.7 The Minister may issue an equivalency certificate that was refused or reissue an equivalency certificate that was revoked if the Minister is satisfied, on the basis of the information available and the information submitted with the request for review, that the activity authorized by the equivalency certificate will provide a level of safety at least equivalent to that provided by compliance with the Act and these Regulations.
Notification of a Decision
14.8 The Minister must notify, in writing, the person who made the request for a review of the decision and the reasons for the decision.
60 Paragraphs 15.1(a) and (b) of the Regulations are replaced by the following:
- (a) provide a summary of the order, in writing, to the Minister within 30 days after the day on which the order is made; and
- (b) give to the Minister the amount in the form of a certified cheque, money order or bank draft, payable to the Receiver General for Canada, within the period established by the court or, if no period is established, within 90 days after the day on which the order is made.
Column 6(a) | Explosive Limit and Limited Quantity Index. This column gives the maximum quantity of dangerous goods that may be offered for transport, handled or transported. The quantity limit is expressed in kilograms for solids, in litres for liquids and, for gases, as the capacity in litres of the means of containment. For Class 1, the quantity limit is expressed either in kilograms of net explosives quantity or, if the explosives are subject to special provision 85 or 86, in number of articles. |

REGULATORY IMPACT ANALYSIS STATEMENT
(This statement is not part of the Regulations.)
Issues
Over the years, Transport Canada (TC) has identified several minor technical and administrative amendments that must be made to the Transportation of Dangerous Goods Regulations (TDGR). These amendments include typographical and punctuation errors, formatting, and numbering changes, as well as minor inconsistencies between the English and French versions of the TDGR. These required amendments have been identified in correspondence from stakeholders and internal reviews.
Additionally, technical amendments should be made to the TDGR for consistency with the Transportation of Dangerous Goods Act (the Act).
Objective
The objectives of these regulatory amendments are to
- repeal obsolete regulatory provisions that have no current application;
- correct discrepancies between the French and English versions;
- harmonize terms used in the TDGR with those used in the Act or related regulations;
- clarify existing provisions;
- correct typographical, grammatical, spelling, numbering, and punctuation errors; and
- update references to standards and other documents incorporated by reference.
Description
Since the amendments to the Act came into force in 2009, TC has been compiling a list of minor administrative corrections that should be made to the TDGR. The amendments include 117 administrative changes that will modernize, correct, enhance the clarity of the TDGR, and harmonize the TDGR with the Act. The changes are grouped into the following categories:
Repealing obsolete regulatory provisions that have no current application
Two changes are made to the TDGR in this category:
- Section 13.3: Section 13.3 refers to the Minister’s obligation to notify the person who requested a review of a protective directionfootnote 2 of the decision made for that request. This section will be repealed as it is an administrative provision regulating the Minister. Also, as the principles of natural justice and procedural fairness would apply, the reason behind the Minister’s decision would be provided to the person who made the request for a review thus making section 13.3 redundant.
- Subsections 1.17(6) and 1.17(7): Subsection 1.17(6) is repealed as it is a transitional provision that allowed regulated parties to comply with either the “new” regulations or the “old” regulations for a period of time, in this case until December 31, 2020, and is no longer needed. Subsection 1.17(7) is repealed as it is now a spent provision since its application was limited by the transitional provision of subsection 1.17(6). These changes will lighten the regulatory text for added clarity.
Correcting discrepancies between the English and French
There are 11 amendments made to the TDGR in this category. Some examples include
- The table to paragraph 1.3(2)(e) in the English version: The term “cubic feet” is replaced with “cubic foot” to align with the French version.
- Section 1.4 of the French version: The following definition “fût Contenant de métal, de carton, de plastique ou d’un autre matériau semblable dont les extrémités sont plates ou convexes et qui possède une capacité maximale de 450 L ou, dans le cas d’un fût de contreplaqué, une capacité maximale de 250 L. La présente définition inclut les contenants d’autres formes, tels que les contenants en forme de seau ou les contenants circulaires avec un goulot conique, mais exclut les tonneaux et les jerricanes (contenants de coupe rectangulaire ou polygonale). (drum)” is replaced by “fût Contenant cylindrique de métal, de carton, de plastique ou d’un autre matériau semblable dont les extrémités sont plates ou convexes et qui possède une capacité maximale de 450 L ou, dans le cas d’un fût de contreplaqué, une capacité maximale de 250 L. - Schedule 3, column 1A in the French version and in column 1B in the English version: The text “PYRÉTHROÏDE PESTICIDE LIQUIDE, TOXIQUE, INFLAMMABLE, ayant un point d’éclair égal ou inférieur à 23 °C” is replaced by “PYRÉTHROÏDE PESTICIDE LIQUIDE, TOXIQUE, INFLAMMABLE, ayant un point d’éclair égal ou supérieur à 23 °C” to reflect the English version and the United Nations (UN) Recommendations.footnote 3
Harmonizing terms used in the TDGR to align with the modifications made to the Act in 2009
There are 61 amendments (divided into seven different themes) made to the TDGR in this category. These changes are
- The following definitions are repealed: certification safety mark, dangerous goods safety mark, director general, import, permit for equivalent level of safety, safety mark and standardized means of containment for the following reasons:
- Certification safety mark is repealed and replaced by Compliance mark that was introduced in the Act in 2009. This change will align the TDGR with the wording of the Act for internal consistency with no change in the meaning.
- Dangerous goods safety mark: “Dangerous goods mark” is already defined in the Act. The term “dangerous goods safety mark” is replaced with “dangerous goods mark” throughout the TDGR to reflect the terminology being used in the Act. This change will align the TDGR with the wording of the Act for internal consistency with no change in the meaning.
- Director General is repealed to ensure that the TDGR are aligned with the Act, which specifies the “Minister.” The term “director general” is replaced with “minister” throughout the TDGR to reflect the terminology being used in the Act.
- Import: The definition of “import” in the Act was repealed in 2009. As such the definition in the TDGR is repealed to align with the Act.
- Permit for equivalent level of safety: In 2009, section 31 of the Act was amended to change from the term “Equivalent level of safety permits” to “Equivalency certificate.” As a result of this terminology change, the definition of “permit for equivalent level of safety is no longer useful in the TDGR. The term “permit for equivalent level of safety” is replaced with “equivalency certificate” throughout the TDGR to reflect the terminology being used in the Act.
- Safety mark and standardized means of containment: Both terms are already defined in the Act and, therefore, do not need to be defined in the TDGR.
- 14 instances of the term “hazard” is replaced with “danger,” along with any necessary grammatical modifications. This amendment will reflect the wording in the Act and UN Recommendations and better reflect the intention in terms of safety.footnote 4 This amendment will not have any impact as it is simply a terminology clarification.
- The phrase “handle, offer for transport, transport or import” is replaced with “import, offer for transport, handle or transport” along with any necessary grammatical modifications. This amendment will align the TDGR with the wording of the Act for internal consistency with no change in the meaning.
- The term “accidental release” is replaced with “release,” along with any necessary grammatical modifications to reflect the terminology being used in the Act.
Clarifying existing provisions
There are 21 amendments made to the TDGR in this category. Some examples include:
- Sections 1.1 (Coming into Force) and 1.2 (Repeal): Both sections are repealed as they were introduced in 1985 when a new (at the time) version of the TDGR was published. These sections are no longer required. Repealing the two sections will lighten the regulatory text for added clarity.
- The table under paragraph 1.3(2)(e) is amended by repealing the “psig” entry in column 1 and “pounds per square inch, gauge” in column 2, as these terms are no longer used in the TDGR.
- Paragraphs 1.31(a) and (b) are modified to repeal unnecessary text that is found in the legend of schedule 1 as there is no need to have it in both places. Paragraph 1.31(a) has been reworded to no longer use the expression “expressed in net explosives quantity,” and Paragraph 1.31(b) has also been reworded to no longer use the expression “expressed in number of articles” as the Legend of Schedule 1 already provide for that. The amendment removes the redundancy.
- Paragraph 3.5(3)(a) is modified by changing the shipping name from “FUMIGATED UNIT” or “ENGIN SOUS FUMIGATION” to “FUMIGATED CARGO TRANSPORT UNIT” or “ENGIN DE TRANSPORT SOUS FUMIGATION”. This change is being made to be consistent with the terminology used in the current UN Recommendations.
- Subsection 3.6.1(1) is reworded to remove the reference to “Beginning on July 15, 2015”. This amendment is made to improve clarity by repealing the portion of the text related to the date as the identified date has passed and is no longer required.
- Subsection 4.19(3) is amended to include the shipping name and the mention “UN” for “UN3475, ETHANOL AND GASOLINE MIXTURE” in the regulatory text. This will ensure consistency with the other provisions in Part 4.
Updating references that have been amended or that are incorporated by reference in the TDGR
TC exercises due diligence when revising materials incorporated by referencefootnote 5 in the TDGR for relevancy and consistency. For example, TC informs stakeholders when revised standards are published by posting them on TC’s website and through the Federal-Provincial-Territorial Task Force and the TDG General Policy Advisory Council.
There are four amendments made to the TDGR in this category to ensure that references to incorporated documents are accurate and up-to-date.
- Subparagraph 1.16(1)(c)(ii): This subparagraph is modified to include an additional clause, “clause (C)” introducing the Canada Consumer Product Safety Act (CCPSA) and its regulations.footnote 6 This is a technical amendment for added clarity; it is not expected to result in any incremental impacts since stakeholders already need to comply with the CCPSA pursuant to paragraph 12(j) of the Hazardous Product Act.
- Subparagraph 1.49(1)(e)(iv): This subparagraph is modified to replace the reference to the Small Fishing Vessel Inspection Regulations which were repealed and replaced with the Fishing Vessel Safety Regulations in 2017.
- Five provisions of the TDGR containing a reference to the “Packaging and Transport of Nuclear Substances Regulations” are replaced with the most recent version titled “Packaging and Transport of Nuclear Substances Regulations, 2015”.
- Schedule 2, special provision, 155 subsection (1): This subsection is modified to update a cited reference by referring to section “7.1.5” instead of “7.1.6” of the UN Recommendations. The 20th edition of the UN Recommendations no longer contains recommendations under section 7.1.6; the proper reference is now 7.1.5.
Correcting typographical, grammatical, spelling, numbering, and punctuation errors in the TDGR
There are 39 amendments made to the TDGR in this category. Some examples include:
- Schedule 1, column 8 of the legend in the French version: The wording “Le mot « Interdit » dans la cette colonne indique qu’aucune quantité de ces marchandises dangereuses ne peut être transportée à bord d’un bâtiment à passagers.” is replaced by “« Interdit » dans cette colonne indique qu’aucune quantité de ces marchandises dangereuses ne peut être transportée à bord d’un bâtiment à passagers.” to correct a grammatical error.
- Schedule 1, column 9 of the legend in the French version is modified to remove the “s” in “transportées” to correct a grammatical error (“transportée” corresponds with “la quantité”, which is singular).
- Schedule 1, column 2, related to UN number UN1082 in the French version is modified to replace “RERIGÉRANT” with “RÉFRIGÉRANT” to correct a spelling error.
- Schedule 1, column 3 related to UN number UN2498 in the French version is modified to replace “BENZALÉDHYDE” with “BENZALDÉHYDE” to correct a spelling error.
- Schedule 1, column 5, related to UN number UN3269 in both languages is modified to add “141,” to the list of special provisions. This change corrects a mistake made in the SOR/2017-137 where “141” was accidentally removed.
- Schedule 1, column 2, related to UN number UN3344 in the English version is modified to replace “PENTAERYTHROL TETRANITRATE MIXTURE, DESENSITIZED, SOLID” with “PENTAERYTHRITOL TETRANITRATE MIXTURE, DESENSITIZED, SOLID” to correct a spelling error.
- Schedule 2, special provision 69, is modified to remove the hyphen within and add quotation marks around “strike-anywhere” in paragraph (c) to align with the term used in the UN Recommendations and in special provision 21.
All the amendments contained in this proposal are technical and/or administrative in nature and do not change the intent/scope/application of the TDGR. As such, the amendments are not expected to result in any incremental impacts or costs to stakeholders. Furthermore, the amendments are expected to improve readability for stakeholders by improving internal consistency within the TDGR and adopting the terminology of the Act.
One-for-one rule
The one-for-one rule does not apply to these amendments, as there is no change in administrative costs or burden to business.
