BROADCASTING ACT

Whereas, under subsection 10(3)footnote a of the Broadcasting Act footnote b, a copy of the proposed Regulations Amending Certain Regulations Made under the Broadcasting Act, substantially in the annexed form, was published in the Canada Gazette, Part I, on August 5, 2023 and a reasonable opportunity was given to persons carrying on broadcasting undertakings and other interested persons to make representations to the Canadian Radio-television and Telecommunications Commission with respect to the proposed Regulations;

Therefore, the Canadian Radio-television and Telecommunications Commission makes the annexed Regulations Amending Certain Regulations Made Under the Broadcasting Act under subsection 10(1)footnote c of the Broadcasting Act footnote b.

Regulations Amending Certain Regulations Made under the Broadcasting Act

Television Broadcasting Regulations, 1987

1 Subparagraphs (b)(i) and (ii) of the definition Canadian program in section 2 of the Television Broadcasting Regulations, 1987 footnote 1 are replaced by the following:

2 The Regulations are amended by adding the following after section 18:

Transitional provision

19 A program that, before November 1, 2023, qualified as a Canadian program under subparagraph (b)(i) or (ii) of the definition Canadian program in section 2, as it read immediately before that day, continues to qualify as a Canadian program for the purposes of these Regulations.

Discretionary Services Regulations

3 Subparagraphs (b)(i) and (ii) of the definition Canadian program in section 1 of the Discretionary Services Regulations footnote 2 are replaced by the following:

4 Section 18 of the Regulations is replaced by the following:

18 A program that, before November 1, 2023, qualified as a Canadian program under subparagraph (b)(i) or (ii) of the definition Canadian program in section 1, as it read immediately before that day, continues to qualify as a Canadian program for the purposes of these Regulations.

Coming into Force

5 These Regulations come into force on November 1, 2023.

EXPLANATORY NOTE

(This note is not part of the Regulations.)

The Regulations will update the definition of the term “Canadian program” in the Television Broadcasting Regulations, 1987 and the Discretionary Services Regulations to make reference to Broadcasting Regulatory Policy CRTC 2023-90, in which the Commission amended the treatment of stock footage costs. The Regulations will also grandfather productions that qualify as Canadian programs under subparagraphs (b)(i) or (ii) of the definition of “Canadian program,” as currently set out in the Television Broadcasting Regulations, 1987 and the Discretionary Services Regulations.
