The Minister of Finance makes the annexed Order Amending the List of Tariff Provisions Set Out in the Schedule to the Customs Tariff (Tariff Item No. 9984.00.00) under section 13footnote a of the Customs Tariff footnote b.

Order Amending the List of Tariff Provisions Set Out in the Schedule to the Customs Tariff (Tariff Item No. 9984.00.00)

Amendment

1 The Description of Goods of tariff item No. 9984.00.00 in the List of Tariff Provisions set out in the schedule to the Customs Tariff footnote b is amended by replacing the reference to “True Sport Foundation” with a reference to “Canadian Olympic Committee”.

Coming into Force

2 This Order comes into force on the day on which it is registered.

Issues

The True Sport Foundation and Canadian Olympic Committee have jointly requested that the certifying body named in tariff item No. 9984.00.00 be changed from the True Sport Foundation to the Canadian Olympic Committee.

Background

Tariff item No. 9984.00.00 allows for the duty-free importation of goods used in high-level amateur sport competitions, under certain conditions, including that the goods are certified as (1) complying with the international competition standards applicable to the sport for which the goods are designed; and (2) being required by an athlete exclusively for the purpose of training for or competing in an amateur competition of international calibre. The True Sport Foundation has been the certifying body for the purposes of this tariff item since 2016.

Description and rationale

This Order changes the certifying body for the purposes of tariff item No. 9984.00.00 from the “True Sport Foundation” to the “Canadian Olympic Committee.” There are no other changes to the tariff item. The amendment is technical in nature and does not have policy or financial implications.

The True Sport Foundation and the Canadian Olympic Committee have agreed that the Canadian Olympic Committee is better placed to undertake the certification process, which will continue to be done on a cost-recovery basis.

One-for-one rule and small business lens

The one-for-one rule does not apply to these amendments, as there is no change in administrative costs or burden to businesses.

The small business lens does not apply to this Order, as there is no change in administrative or compliance costs to small businesses.

Consultation

The True Sport Foundation and the Canadian Olympic Committee were consulted and are supportive of the amendment.

Implementation, compliance and enforcement, and service standards

The Canada Border Services Agency (CBSA) is responsible for the administration of, and compliance with, customs and tariff legislation and regulations. In the course of its administration of this tariff amendment, CBSA will inform the importing community.
