FARM PRODUCTS AGENCIES ACT
Whereas the Governor in Council has, by the Canadian Hatching Egg Producers Proclamation footnote a, established the Canadian Hatching Egg Producers (“the Agency”) under subsection 16(1)footnote b of the Farm Products Agencies Act footnote c;
Whereas the Agency has been empowered to implement a marketing plan under that Proclamation;
Whereas the proposed Order Amending the Canadian Broiler Hatching Egg Marketing Levies Order is an order of a class to which paragraph 7(1)(d)footnote d of that Act applies, by reason of section 2 of the Agencies’ Orders and Regulations Approval Order footnote e, and has been submitted to the National Farm Products Council under paragraph 22(1)(f) of that Act;
And whereas, under paragraph 7(1)(d)footnote d of that Act, the National Farm Products Council has approved the proposed Order after being satisfied that it is necessary for the implementation of the marketing plan that the Agency is authorized to implement;
Therefore, the Canadian Hatching Egg Producers makes the annexed Order Amending the Canadian Broiler Hatching Egg Marketing Levies Order under paragraph 22(1)(f) and (g)footnote f of the Farm Products Agencies Act footnote c and section 8 of the schedule to the Canadian Hatching Egg Producers Proclamation footnote a.

Order Amending the Canadian Broiler Hatching Egg Marketing Levies Order
Amendments
1 (1) Paragraph 2(1)(e) of the Canadian Broiler Hatching Egg Marketing Levies Order footnote 1 is replaced by the following:
- (e) in the Province of Saskatchewan, $0.021400; and
(2) Subsection 2(2) of the Order is replaced by the following:
(2) A levy is imposed on a producer, dealer or hatchery operator in a non-signatory province of $0.016137 per broiler hatching egg produced in any non-signatory province and marketed by that producer, dealer or hatchery operator in interprovincial trade into a signatory province.
Coming into Force
2 This Order comes into force on January 28, 2024, but if it is registered after that day, it comes into force on the day on which it is registered.
EXPLANATORY NOTE
(This note is not part of the Order.)
The amendments set the levies imposed on producers in Saskatchewan for broiler hatching eggs marketed by those producers in interprovincial or export trade. They also set the levy on producers, dealers and hatchery operators in non-signatory provinces for broiler hatching eggs marketed in interprovincial trade into signatory provinces. In addition, the amendments replace subsection 2(2) of the Order.
