SPECIAL IMPORT MEASURES ACT

Corrosion-resistant steel sheet — Decision

On July 26, 2018, pursuant to subsection 31(1) of the Special Import Measures Act (SIMA), the Canada Border Services Agency (CBSA) initiated an investigation into the alleged injurious dumping of certain corrosion-resistant steel sheet from China, Chinese Taipei, India and South Korea.

The subject goods are usually imported under the following tariff classification numbers:

The Canadian International Trade Tribunal (CITT) will conduct a preliminary inquiry into the question of injury to the Canadian industry. The CITT will make a decision within 60 days of the date of initiation. If the CITT concludes that the evidence does not disclose a reasonable indication of injury, the investigation will be terminated.

Interested persons are invited to file written submissions presenting facts, arguments and evidence relevant to the alleged dumping. Written submissions should be forwarded to the Canada Border Services Agency, Trade and Anti-dumping Programs Directorate, SIMA Registry and Disclosure Unit, 100 Metcalfe Street, 11th Floor, Ottawa, Ontario K1A 0L8. To be given consideration in the investigation, this information should be received by November 30, 2018.

Any information submitted by interested persons concerning the investigation will be considered public information unless clearly marked confidential. When a submission is marked confidential, a non-confidential edited version of the submission must also be provided.

The Canadian International Trade Tribunal hereby gives notice that, pursuant to subsection 34(2) of the Special Import Measures Act (SIMA), it has initiated a preliminary injury inquiry (Preliminary Injury Inquiry No. PI-2018-004) to determine whether the evidence discloses a reasonable indication that the dumping of carbon steel welded pipe, commonly identified as standard pipe, in the nominal size range from ½ inch up to and including 6 inches (12.7 mm to 168.3 mm in outside diameter) inclusive, in various forms and finishes, usually supplied to meet ASTM A53, ASTM A135, ASTM A252, ASTM A589, ASTM A795, ASTM F1083 or Commercial Quality, or AWWA C200-97 or equivalent specifications, including water well casing, piling pipe, sprinkler pipe and fencing pipe, but excluding oil and gas line pipe made to API specifications exclusively, originating in or exported from the Islamic Republic of Pakistan, the Republic of the Philippines, the Republic of Turkey and the Socialist Republic of Vietnam, has caused injury or retardation or is threatening to cause injury, as these words are defined in SIMA.

The Tribunal's preliminary injury inquiry will be conducted by way of written submissions. Each person or government wishing to participate in the preliminary injury inquiry must file a notice of participation with the Tribunal on or before August 2, 2018. Each counsel who intends to represent a party in the preliminary injury inquiry must file a notice of representation, as well as a declaration and undertaking, with the Tribunal on or before August 2, 2018.

On August 7, 2018, the Tribunal will issue a list of participants. Counsel and parties are required to serve their respective submissions on each other on the dates outlined below. Public submissions are to be served on counsel and those parties who are not represented by counsel. Confidential submissions are to be served only on counsel who have access to the confidential record and who have filed an undertaking with the Tribunal. This information will be included in the list of participants. One complete electronic version of all submissions must be filed with the Tribunal.

Submissions by parties opposed to the complaint must be filed not later than noon, on August 17, 2018. The complainant may make submissions in response to the submissions of parties opposed to the complaint not later than noon, on August 24, 2018. At that time, other parties in support of the complaint may also make submissions to the Tribunal.

The Tribunal's preliminary injury inquiry will be conducted by way of written submissions. Notice is hereby given that, on July 26, 2018, the Canadian International Trade Tribunal found (Inquiry No. NQ-2017-005), pursuant to subsection 43(1) of the Special Import Measures Act, that the dumping and subsidizing of all dry wheat-based pasta, not stuffed or otherwise prepared, and not containing more than two percent eggs, whether or not enriched, fortified, organic, whole wheat or containing milk or other ingredients, originating in or exported from the Republic of Turkey, excluding refrigerated, frozen or canned pasta, have caused injury to the domestic industry.

Task-based informatics professional services

The Canadian International Trade Tribunal has received a complaint (File No. PR-2018-015) from SoftSim Technologies Inc. (SoftSim), of Montréal, Quebec, concerning a procurement (Solicitation No. 18-22022) by the National Research Council of Canada (NRC). The solicitation is for task-based informatics professional services. Pursuant to subsection 30.13(2) of the Canadian International Trade Tribunal Act and subsection 7(2) of the Canadian International Trade Tribunal Procurement Inquiry Regulations, notice is hereby given that the Tribunal made a decision on July 23, 2018, to conduct an inquiry into the complaint.

SoftSim alleges that the NRC erred in its evaluation of certain point-rated criteria in SoftSim's technical bid.
